Senate Bill 1241 would prevent localities from establishing regulations for working animals or commerce that uses services provided by working animals. 

It would define the term “working animal” as an animal providing services to business involved in “hunting, entertainment, equine riding and carriage driving, transportation, education, exhibition, agritourism, ranching, livestock guardianship or herding, farming, logging, or other service or activity that has traditionally involved the utilization of working animals.”

It would prevent any locality from creating ordinances or regulations that impact or ban commercial enterprises that are dependent on working animals. The bill specifically lists cockfighting and dogfighting as activities that would continue to be prohibited. It also clarifies that the new statute would not prevent enforcement of the Local Land Use Planning Act or other existing laws related to public health and safety.

SB 1241 would weaken Idaho’s longstanding animal welfare protection and create unintended consequences. The legislation could impact or invalidate leash laws, commercial puppy sales ordinances, kennel regulations, quarantine rules and zoning restrictions adopted by counties and municipalities all across Idaho.

Idaho’s current animal cruelty laws are some of the weakest in the entire country. Animal treatment and husbandry legislation need to be strengthened, not further weakened by broad definitions of “working animals.”
