Sen. Burtenshaw (R-Terreton) and Rep. Jerald Raymond (R-Menan) introduced Senate Bill 1443 in the Senate Resources & Environment Committee. The bill replaces HB 434 and is largely similar, requiring the Idaho Board of Land Commissioners to mandate remediation for all leases, permits, or contracts on state lands. While mineral leases already require reclamation under state law, the proposal would require remediation and restoration for all permit holders and lessees if they operate on state land. The bill is more specific than its predecessor, providing that a bond may be secured from the lessee to require land remediation upon expiration or cancellation of the lease. It also provides that the Idaho department of Lands can promulgate rules for leasing activities that may come before the board or department for consideration, pending legislative approval.
